Wedding Photography Agreement

This agreement contains the entire understanding between Life’s Moments Photography by Kimberly Joy, hereby known as LMPKJ and _____________________________________________________, hereby known as the CLIENT. The only way to change this agreement is to do so in writing, signed by all parties.

 

RESERVATION: A signed agreement and a 25% Retainer of the total package is required to reserve the specified coverage date and time of shooting. This Retainer is non-refundable, as LMPKJ will block their calendar for that date and time from any other shoots. The balance of the package is due 14 days prior to the first scheduled shooting date.

 

SHOOTING TIME: Shooting will commences at the scheduled start time. LMPKJ is not responsible if any individuals fail to appear or their lack of cooperation during the photography sessions or for any missed images due to details not revealed to LMPKJ. Time not used due to a shortened event/shoot will not be carried over to another event/shoot or adjusted for lost of time…

 

HOUSE RULES: LMPKJ is limited by any and all guidelines imposed by the ceremony official, the venue or reception site management. The CLIENT agrees to accept any and all technical results by the imposition of the guidelines set on the photographer. Negotiation with ceremony officials, the venue or reception site management for moderation of the guidelines is the Client’s responsibility.

 

EXHIBITION: The CLIENT grants Kimberly J.A Rizzo and/or LMPKJ permission to display images resulting from this shooting assignment as photo examples of LMPKJ work and their use for entrance in photographic competitions. The CLIENT releases all claims to any profits or benefits that may arise from use of the images.

 

COPYRIGHT: The CLIENT understands and agrees that the images from all photographs taken become and remain the property of LMPKJ.

 

LIMIT OF LIABILITY: If LMPKJ cannot perform in whole or in part due to causes beyond control, LMPKJ will make every effort to secure a replacement photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package. LMPKJ takes the utmost care with respect to exposure, transportation and processing the photographs; however, in the unlikely event that the photographs have been lost, stolen, or destroyed for reasons within or beyond control, LMPKJ liability is limited to the return of all payments received for event package. The limit of liability for partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals. This includes any equipment failure or image transfer loss. Once CLIENT receives the picture CD, LMPKJ is no longer responsible to keep on file any of Client’s pictures taken for the event listed in this agreement.

 

CANCELLATION POLICY: If for any reason the CLIENT cancels their wedding, Retainer is non refundable. If the wedding is cancelled within the 7 days prior to the wedding day, Client will be charged 100% of total photographic services.

 

PAYMENT SCHEDULE: 25% security Retainer due at time of signing of agreement. Balance paid in full is due 14 days prior to wedding. Any additional prints ordered are to be paid for at time of order. This signed agreement and deposit fee are required to reserve the specified coverage.
